All contractual obligations toward customers remain with FUTURE DIGITAL JOURNEY PTE. LTD.

MarktWoosh provides subscription-based, done-for-you digital services, including but not limited to:
Website design, development, hosting, and maintenance
SEO and AEO (Answer Engine Optimisation) foundations
Optional add-ons include additional pages, language versions, SEO content (Traffic Magnet), Google Business Profile management, professional email, and advertising management. Full details and pricing are available at marktwoosh.com/pricing.
MarktWoosh is not a DIY software tool and not a custom agency project.

3. Nature of the Subscription Service
All MarktWoosh services are provided only for the duration of an active subscription.
Websites remain active, hosted, and maintained while the subscription is active
Service access, hosting, and maintenance end when the subscription ends or is cancelled
The service is provided as a managed solution, not as a one-time deliverable

4. Subscription Plan
MarktWoosh currently offers one core subscription plan:
Woosh Website+ — €99/month
Inclusions are defined on the pricing page at the time of subscription. Optional add-ons may be purchased separately in addition to the core plan.

5. Delivery Timeline
Following receipt of a completed onboarding intake form, MarktWoosh will aim to deliver the initial website within 10 business days.
The delivery timeline is conditional on the timely provision of required content, materials, and information by the client. Delays caused by incomplete or late submissions from the client will extend the delivery timeline accordingly. The 10-business-day period begins only once the onboarding intake is fully completed.

Delays caused by incomplete or late submissions from the client will extend the delivery timeline accordingly. The 10-business-day period begins only once the onboarding intake is fully completed.
6. Client Responsibilities
Clients agree to:
Provide accurate, complete, and lawful content
Respond to onboarding and update requests within a reasonable timeframe
Ensure they have all necessary rights to content they provide (text, images, logos, etc.)
Comply with applicable laws and regulations related to their business and industry

7. Revisions & Change Requests
The Woosh Website+ plan includes 1 (one) change request per month as part of ongoing support.
The following are out of scope and may require add-ons or additional fees:
Structural redesigns or major layout changes

Unused change requests do not carry over to the following month.

Hosting, security, updates, and maintenance are included during an active subscription
Infrastructure and technical environments are managed exclusively by MarktWoosh
Clients do not receive direct server, platform, or system-level access
Analytics and performance data are accessible to clients via the MarktWoosh dashboard

9. Subscription, Billing & Payments
Subscriptions are billed monthly in advance via Stripe
Prices are displayed in Euros (€) unless stated otherwise
No refunds are provided for active or partially used billing periods, except as required by applicable law
Add-ons are billed separately at the rates published at the time of purchase

10. Right of Withdrawal for EU Consumers
If you are a consumer located in the European Union, you have the right to withdraw from this contract within 14 days of conclusion without giving any reason.
However, by completing your subscription purchase and requesting immediate access to the service, you expressly consent to the commencement of the service before the expiry of the 14-day withdrawal period. You acknowledge that your right of withdrawal is lost once the service has commenced.
If you cancel before the service has commenced, you are entitled to a full refund of your first payment. If the service has already commenced (for example, onboarding has been initiated or website work has begun), the withdrawal right is forfeited and no refund applies to that billing period.

10. Right of Withdrawal for EU Consumers
If you are a consumer located in the European Union, you have the right to withdraw from this contract within 14 days of conclusion without giving any reason.
However, by completing your subscription purchase and requesting immediate access to the service, you expressly consent to the commencement of the service before the expiry of the 14-day withdrawal period. You acknowledge that your right of withdrawal is lost once the service has commenced.
If you cancel before the service has commenced, you are entitled to a full refund of your first payment. If the service has already commenced (for example, onboarding has been initiated or website work has begun), the withdrawal right is forfeited and no refund applies to that billing period.

Services continue until the end of the current billing period
The website will be taken offline once the subscription period ends
Hosting, maintenance, and support cease upon subscription end
Domain names registered or managed by the client remain the client's property

12. Ownership & Intellectual Property
12.1 Client Ownership
Clients retain ownership of:

Content they provided (text, images, logos, products, and other materials submitted by the client)
12.2 MarktWoosh Ownership
FUTURE DIGITAL JOURNEY PTE. LTD. retains full ownership of:
Website structure, codebase, templates, layouts, and configurations
Design systems and internal frameworks
Content created by MarktWoosh (text, graphics, icons, articles, and other materials produced by MarktWoosh)
The MarktWoosh dashboard and all associated tools and infrastructure
Clients are granted a limited, non-transferable licence to use the website only during an active subscription. This licence terminates immediately upon cancellation or termination of the subscription.
12.3 Digital Advertising Account Ownership
When advertising services are subscribed to as an add-on, all advertising accounts created and managed by MarktWoosh — including but not limited to Google Ads accounts, Meta Ads accounts, TikTok Ads accounts, and LinkedIn Ads accounts — are created under and remain the property of FUTURE DIGITAL JOURNEY PTE. LTD.
Clients acknowledge that:
Advertising accounts created by MarktWoosh in connection with the service belong to MarktWoosh
Campaign data, audience data, conversion history, and account history within these accounts are the property of MarktWoosh
Upon cancellation or termination, clients do not retain access to or ownership of advertising accounts or their historical data
Ad spend deposited by clients for campaign delivery will be applied to campaign costs; unused ad spend at the time of cancellation is non-refundable unless otherwise agreed in writing
MarktWoosh will make reasonable efforts to pause active campaigns upon cancellation notice. Ad spend already submitted to third-party platforms (Google, Meta, TikTok, LinkedIn) is subject to those platforms' own refund policies and cannot be recovered by MarktWoosh.
12. Ownership & Intellectual Property

Their registered domain name

13. Website Handover (Ownership Transfer)
If a client wishes to take ownership of their website upon cancellation, a one-time website handover fee applies.
Handover fee: €2,000
The following conditions must be met before a handover request can be processed:
The client must have maintained an active, uninterrupted subscription for a minimum of 12 consecutive months
All outstanding subscription and add-on payments must be settled in full
The handover request must be submitted in writing to contact@marktwoosh.com
Handover includes:
Transfer of website files and assets in an agreed format
Basic documentation or export where technically applicable
MarktWoosh reserves the right to:
Decline handover requests if technically infeasible given the platform or infrastructure used
Define the scope and format of the handover
Require full payment before initiating the handover process
Important: Advertising accounts (Google Ads, Meta Ads, TikTok Ads, LinkedIn Ads, and any other platforms) are not included in any handover or ownership transfer. These accounts remain the property of FUTURE DIGITAL JOURNEY PTE. LTD. under all circumstances.

Clients are responsible for ensuring their business and products comply with applicable advertising platform policies

Ad spend management is conducted by MarktWoosh on the client's behalf within the agreed budget
A minimum ad spend of €300 per month per channel is required for MarktWoosh to manage advertising campaigns effectively. Campaigns cannot be activated below this threshold.

16. Limitation of Liability
To the maximum extent permitted by applicable law:
MarktWoosh shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use our services
Total liability is limited to the amount paid by the client in the three (3) months immediately preceding the claim

19. Governing Law & Jurisdiction

EU consumers retain any mandatory rights granted under the laws of their country of residence that cannot be contractually waived.
